Filing and Service Fees
T.C.A. §8-21-401, governs clerk’s fees throughout Tennessee and has been amended to provide for standard filing fees to be paid in advance unless otherwise specified. These changes affect fees for all clerks across the state except in Knox County.
The following filing fees must be paid when the case is filed. IF COST BOND IS FILED, $57.50 LITIGATION TAXES MUST STILL BE PAID.
Civil Rights Suit $284.50 or file cost bond
Contract $284.50 or file cost bond
Discrimination $284.50 or file cost bond
Injunction $284.50 or file cost bond
Property Dispute $284.50 or file cost bond
Special Remedy $284.50 or file cost bond
Tax Dispute $284.50 or file cost bond
Actions not otherwise designated $284.50 or file cost bond
Workers Compensation $209.50 or file cost bond
The following filing fees must be paid when case is filed – NO COST BOND ALLOWED:
Administrative Hearing $209.50
Enforcement of Foreign Judgment $159.50
Minor Settlement $159.50
Name Change $159.50
Transfer from another county $209.50
Writ of Certiorari $209.50
Writ of Mandamus $209.50
The following fees are required at the time the service is requested. NO COST BOND IS ALLOWED.
- Third Party-Complaint party filing pays same fee charged for the original petition less $57.50
- Cross-Complaint or Counter-Complaint $102.00
- Intervening Complaint $227.00
- Publication $25.00
- Subpoena $6.00
- Preparing Record on Appeal – payable upon filing of Notice of Appeal with the Appellate Court Clerk $300.00
- Pre-Judgment Attachment or other process to seize property prior to judgment being rendered $40.00
- Post Judgment Requests $25.00 (applies to each requested execution, garnishment, levy, post judgment interrogatory, motion to pay judgment by installments, and post judgment orders and pleadings)
- Motion to Pay by Installments $25.00
- Post Judgment Order $25.00
- Receiving Funds on Confirmation of Private Sale/Funds Paid to Clerk $40.00 pursuant to Pre-Judgment Attachment or Similar Process
- Continuance $7.00*
*taxed at discretion of the judge and collected at end of case
